Terms of Service

1. Agreement

By renting equipment from or using the website of Ace Basin Equipment LLC ("Ace Basin Equipment"), you agree to these Terms of Service. These terms constitute a binding agreement between you ("Customer") and Ace Basin Equipment.

2. Equipment Rental

Ace Basin Equipment provides equipment rental services in Walterboro, SC and the surrounding ACE Basin Lowcountry region. All rentals are subject to equipment availability and Customer's execution of a rental agreement at the time of rental. Rates and availability are subject to change without notice.

3. Delivery and Pickup

Delivery and pickup services are available within our service area for an additional fee. Customer is responsible for providing safe access to the delivery site. Ace Basin Equipment is not liable for damage to underground utilities, irrigation systems, or soft ground caused by delivery vehicles unless Customer has provided accurate site information.

4. Equipment Damage and Liability

Customer assumes full responsibility for rented equipment from the time of delivery or pickup through the time of return or collection. This includes:

• Damage: All damage occurring during the rental period, regardless of cause (accident, weather, misuse, or third-party action), is the Customer's financial responsibility
• Theft or loss: Customer is responsible for the full replacement cost of any stolen or lost equipment
• Improper use: Damage caused by operating equipment outside its design parameters or without proper training
• Underground damage: Damage to underground utilities caused by Customer's failure to call 811 before digging

Customers are advised to call 811 (Call Before You Dig) at least 3 business days before beginning any excavation. Ace Basin Equipment is not responsible for damage to utilities resulting from Customer's failure to do so.

Damage charges will be assessed at current repair or replacement costs. Customers are encouraged to carry general liability insurance and equipment rental coverage prior to use.

5. Equipment Operation

Customer represents that they are qualified and trained to operate any rented equipment. Ace Basin Equipment does not provide operators unless specifically agreed upon separately. Operating equipment without proper training is a breach of this agreement and may result in termination of the rental and forfeiture of any deposits.

6. Payment

Rental rates are due per the agreed rental period (daily, weekly, or monthly). A deposit may be required. Fuel charges apply — equipment must be returned with the same fuel level as at time of rental or a refueling fee will apply. Overdue rentals accrue additional rental charges at the standard daily rate.

7. Prohibited Uses

Rented equipment may not be:

• Subleased or rented to third parties
• Removed from the agreed service area without written permission
• Used for purposes inconsistent with the equipment's design specifications
• Operated by anyone other than Customer or their authorized employees

8. Limitation of Liability

Ace Basin Equipment's total liability for any claim shall not exceed the rental fees paid for the relevant rental period. We are not liable for indirect, consequential, or punitive damages arising from equipment use or unavailability.

9. Indemnification

Customer agrees to indemnify and hold harmless Ace Basin Equipment LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from Customer's use of rented equipment or breach of this agreement.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina. Any disputes shall be resolved exclusively in the courts of Colleton County, South Carolina.
